Tipologie di dati raccolti

I dati personali raccolti dal Titolare in maniera automatizzata sono costituiti esclusivamente da dati tecnici e analitici, raccolti automaticamente mediante l’uso di cookies tecnici o di log automatici.

E’ facoltà degli Utenti iscriversi al sito fornendo al Titolare i seguenti dati: nome, cognome, email, alias, azienda o ente, al fine di utilizzare i servizi richiesti ovvero inviare segnalazioni secondo la normativa vigente.

In caso di invio di segnalazioni per l’accessibilità, oltre ai dati sopra riportati, potrà essere richiesta anche la copia di un documento d’identità.

Il Titolare garantisce che tratterà i dati in modo lecito e secondo correttezza al fine di fornire i servizi richiesti e di rispondere alle comunicazioni e alle domande degli Utenti, sempre nel perseguimento degli scopi istituzionali dell’Agenzia previsti dalla Legge.

Finalità del trattamento

I dati degli Utenti sono raccolti esclusivamente per consentire al Titolare di erogare uno o più dei seguenti servizi o svolgere le seguenti attività:

• Inserimento/aggiornamento dati su elenchi pubblici;
• Scarico massivo di dati pubblici in formato OPEN o in altro formato;
• Invio della comunicazione istituzionali;
• Ricezione comunicazioni istituzionali e/o segnalazioni secondo le normative vigenti;
• Gestione tecnica sito web e gestione utenze;
• Gestione dati analitici e di traffico sito web.

Gli Utenti che dovessero avere dubbi sulla finalità della raccolta dei dati o su quali dati siano effettivamente acquisiti, sono invitati a contattare il Titolare.

Nel caso in cui gli Utenti considerassero i dati richiesti eccessivi rispetto alle finalità sopra indicate, possono rivolgersi al Responsabile della Protezione dei Dati.

Base giuridica del trattamento

I dati personali sono trattati dal Titolare previo consenso dell’Utente ovvero nell’esecuzione dei propri compiti istituzionali di interesse pubblico o comunque connessi all’esercizio dei propri poteri e doveri istituzionali.

Categorie di destinatari dei dati

Il Titolare, nello svolgimento delle proprie attività e per erogare i propri servizi, potrebbe trasmettere i dati alle seguenti categorie di Destinatari:

• Pubbliche Amministrazioni;
• Fornitori di servizi tecnici e hosting provider.

I Destinatari sono nominati, se necessario, Responsabili del Trattamento da parte del Titolare. L’elenco aggiornato dei Responsabili potrà sempre essere richiesto al Titolare del Trattamento.

I Fornitori, in base al contratto di servizio stipulato, sono tenuti a utilizzare i dati personali esclusivamente per le finalità indicate dal Titolare, a non conservarli oltre la durata indicata né a trasmetterli a terzi senza l’esplicita autorizzazione del Titolare.

Trasferimento dei dati in Paesi terzi o a organizzazioni internazionali

Il Titolare non intende trasferire i dati personali a Paesi terzi o a organizzazioni internazionali.

Modalità del trattamento dei dati raccolti

Modalità di trattamento

Il Titolare tratta i dati personali degli Utenti adottando le misure di sicurezza adeguate a impedire l’accesso, la divulgazione, la modifica o la distruzione non autorizzata dei dati personali. Il trattamento viene effettuato anche mediante strumenti informatici e/o telematici, con modalità organizzative e misure tecniche adeguate a garantire la sicurezza dei dati.

Luogo di trattamento

I dati sono trattati presso la sede del Titolare e presso le sedi dei Responsabili ovunque siano localizzate (sempre all’interno della Unione Europea).

Tempi di conservazione dei dati

I dati sono trattati per il tempo necessario allo svolgimento del servizio richiesto dall’Utente o necessario per le finalità descritte nel presente documento ovvero indicate dalla normativa vigente.

Diritti degli Utenti

Gli Utenti, ai quali i dati personali sono riferiti, hanno il diritto in qualunque momento di ottenere la conferma dell'esistenza o meno degli stessi presso il Titolare del Trattamento, di conoscerne il contenuto e l'origine, di verificarne l'esattezza o chiederne l’integrazione, la cancellazione, l'aggiornamento, la rettifica e la limitazione, nonché di opporsi al loro trattamento.

Nei casi in cui l’Utente abbia rilasciato il consenso al trattamento, la relativa revoca non pregiudica la liceità del trattamento svolto precedentemente.

E’ inoltre facoltà dell’Utente richiedere copia dei dati gestiti. Le richieste vanno rivolte al Titolare del Trattamento.

Eventuali reclami possono essere inviati al Responsabile della Protezione dei Dati.

E’ diritto dell’Utente proporre reclamo presso l’Autorità Garante per la protezione dei dati (www.garanteprivacy.it)

Il Titolare garantisce che non è prevista alcuna forma di processo decisionale automatizzato che comporti effetti giuridici sull’Utente.

Ulteriori informazioni sul trattamento

Difesa in giudizio

I dati personali dell’Utente possono essere utilizzati, da parte del Titolare, in giudizio o nelle fasi propedeutiche alla sua eventuale instaurazione per la difesa da abusi da parte dell’Utente.

L’Utente è consapevole che al Titolare potrebbe essere richiesto di comunicare i dati su richiesta delle pubbliche autorità.

Informative specifiche

Su richiesta dell’Utente, in aggiunta alle informazioni contenute nella presente informativa, il Titolare potrebbe fornire all'Utente informative aggiuntive riguardanti servizi specifici o la raccolta e il trattamento di dati personali.

Log di sistema e manutenzione

Per necessità legate al funzionamento e alla manutenzione, potrebbero essere raccolti Log di sistema, ossia file (documenti elettronici) che registrano le interazioni e che possono contenere anche dati personali, quali l’indirizzo IP dell’Utente.

Cookie policy

I cookies sono piccoli file di testo che i siti visitati inviano al terminale dell'Utente, ove vengono memorizzati per poi essere ritrasmessi agli stessi siti alla visita successiva. Il sito utilizza:

• cookies analytics utilizzati per raccogliere informazioni, in forma aggregata, sul numero degli Utenti e su come gli stessi visitino il Sito.

Processing of personal data - The Agency for Digital Italy ensures that the processing of data - whether acquired via e-mail or electronic forms or otherwise - complies with the provisions on personal data protection (Legislative Decree no. 196/2003).

Especially information related to the names and ordinary mail or e-mail addresses provided to the Agency will be used only for the purposes related to RNDT procedures and will not be provided to third parties not involved in those procedures or used for other purposes. Data are processed by means of computer and/or telematic tools by personnel being in charge of carrying out the process and using communications via e-mail.

The content of communications provided to the Agency (requests for information, suggestions, ideas, or other materials of any kind) will not be considered information or data of a confidential nature.

Data accessability - As established by art. 50 of the Digital Administration Code (Legislative Decree 82/2005 and s.m.i.), the transfer of data from one information system to another does not change the ownership of the data.

Linked external web sites - Links to external sites are provided as a service to users, with the exclusion of any responsibility for the correctness and completeness of links indicated. AgID has no responsibility in relation to the legality, completeness and correctness of the information included in the linked sites.

Social media - The RNDT uses social media for institutional purposes: it informs, communicates, listens and publishes contents of an institutional nature.

The published contents may include photographs, images, institutional videos, press releases, service information, news related to the activity of AgID concerning RNDT and, in general, spatial data and geographic information as well as opportunities for involvement and participation of citizens . Through its social channels, RNDT can share content and posts of public interest published by other users.

Social channels are constantly and systematically monitored.

AgID undertakes to manage communication and discussion spaces within its own profiles in the several social platforms, asking its users to respect some simple netiquette rules.

Everyone is responsible for the content he publishes and the opinions he expresses. However, insults, vulgarity, offenses, threats and, in general, violent or defamatory attitudes will not be tolerated. The interest of the topics in relation to the activities of the Agency is an essential requirement: it is not possible in any way to use these spaces for purposes other than those of an institutional nature. No form of advertising, spam or promotion of private interests or illegal activities will be tolerated and content that violates copyright or the unauthorized use of registered trademarks is not permitted.

In any case - where the social media allows it - all posts, comments or audio / video materials that use inappropriate, threatening, violent, vulgar or disrespectful language, that publish illicit, offensive, obscene, deceptive, alarmist, discriminatory contents, that promote or support illegal activities will be removed from the staff.

Responsible organization - The Agency for Digital Italy is in charge of the design, the development, the implementation and the organizational and technology management of the RNDT web site, in according with the art. 8 of Ministerial Decree of 10 November 2011 defining the technical rules of the RNDT.

Purpose of the web site - The RNDT web site aims to facilitate the discoverability of the spatial data made available by the national, regional and local public administrations, in according with the Digital Administration Code (legislative decree 82/2005 and s.m.i.), art. 59.

The RNDT indeed publishes metadata on spatial data sets and services, as well as metadata on spatial data sets that the Public Administrations plan to collect.

Update frequency of the content - The content of the static pages of the web site is updated as deemed necessary.

With regard to the content concerning the information made available by the Public Administrations and metadata on data sets and services held by them, the Ministerial Decree of 10 November 2011 defined the rules for the first formation and updating of the RNDT, namely:

• as regards the first constitution, the Administrations shall publish metadata on data sets and services already available in twelve months from the date of entry into force of the Ministerial Decree and metadata on spatial data sets of general interest that they plan to collect in six months from the date of entry into force of the Ministerial Decree;
• as regards the update, the administrations shall publish metadata on new spatial data of general interest, and related services, in three months from the date of the collection and, at least annually, metadata on data sets that they plan to collect.

Metadata already published in the RNDT will be updated by the Public Administrations as deemed appropriate.
